Today we’re tackling the top three most asked Covenants, Conditions and Restrictions (CC&Rs) questions. Is your first question, what the heck are CC&Rs? Let us explain. Plain and simple – CC&Rs are the rules of your neighborhood. They protect, preserve, and enhance property values in a community.
What do you think the number one question is in regards to community CC&Rs? Yep, neighbor issues.
- If I am having a problem with a neighbor for a violation of the Policies and Guidelines within my CC&Rs, what can I do? (Like maybe a little too much doggie doo on your lawn?)
If residents cannot resolve a situation by themselves, they then turn to their Home Owners Association (HOA). Should you have a situation that does not appear to be resolved through neighborly means, and you are willing to actively participate in the enforcement provided by the Policies and Guidelines of your HOA, you may complete a Covenant Violation form with the managing body. If the situation is deemed in violation of the Policies and Guidelines, enforcement procedures will begin.
- What do my HOA dues cover?
HOA dues cover the operating expenses of the common areas and provide for reserve funds for replacement of common facilities in future years. Think landscaping, utilities, pool maintenance and common area upkeep.
- What happens if I don’t pay my HOA dues?
The maintenance and management services incurred by the HOA are dependent upon timely receipt of the assessments due from each homeowner. Love your community pool? You might not love having an inactivated key card due to unpaid dues. Late payments result in a late charges and often interest as well. Plus, CC&R’s allow the HOA to proceed with a lien on your property, or foreclosure proceeding for nonpayment of assessments.
